In preparation of the implementation of the amended Employment Equity (EE) Act the Department of Labour is to embark on a series of national road shows to strengthen Employment Equity implementation and compliance mechanisms.

The Department of Labour national EE roadshows whose aim it to create awareness on compliance with the EEA will be held under the theme: “Turning a new leaf”.

The national roadshows will culminate on 13 August at the Sandton Convention Centre in Johannesburg, Gauteng Province. The roadshow presentations will be held between 10:00-13:00.

The roadshows are held with the objective to:

 

  • Advocating critical areas in the Employment Equity Amendment Act of 2013,
  • Advocating the Amended Employment Equity Regulations of 2014; and
  • The practical demonstration of the EE Online Reporting facility for the 2014 reporting period.

 

Unlike the previous year, wherein the roadshows’ presentations were sector focused, this year’s

roadshows will be targeted at all sectors.

The roadshows are targeted at human resource executives and practitioners; assigned Senior EE Managers/Transformation Managers and EE forum members.

In terms of the EE Act – “All designated employers whether small or large are now compelled to report every year, failure to comply will result in penalties”.

The amended EE Act was assented by President Jacob Zuma on 14 January 2014. The EE Act is now awaiting implementation.

In February 2014 the Department of Labour also published the Employment Equity Regulations 2014 for public comment, further augmenting government’s commitment towards the promotion of equity and diversity in the workplace.

Labour Minister Mildred Oliphant, acting on the advice of the Commission for Employment Equity in terms of the Employment Equity Act of 1998 signed the notice inviting public comments to give effect to the change. The regulations are expected to give effect to the Employment Equity Amendment Act No.47 of 2013.

The key issues highlighted by the EE Regulations 2014 included the revised definition of designated groups, criteria and methodology for assessing work of equal value, guidelines for assessment of compliance using the national and regional economically active population (EAP) and enforcement mechanisms among key issues.

The EE Act was first promulgated in 1998. A formal process to review the Act followed in 2010.  The Act was introduced in South Africa to address workplace discrimination.

The Department of Labour also wishes to announce that: “the EE reporting period will open on 1 September 2014 for both manual and online, will close for manual on the 1 October 2014 and for online on 15 January 2015”.
